Nativa Terms of Service

1. Agreement and operator
These Terms form an agreement between you and BECOMING LABS LIMITED (New Zealand company number 9436889, NZBN 9429053742971), which publishes and operates Nativa. Registered address: 193 Gillies Avenue, Epsom, Auckland 1023, New Zealand. By installing or using Nativa you agree to these Terms.
2. The service
Nativa is a browser extension and supporting backend that provides AI-assisted communication features, including translation, reply drafting and understanding of messages, images, audio and documents on supported web surfaces. Nativa's content-processing features run when you invoke them or when you have enabled a corresponding user-controlled setting.
3. Eligibility and capacity
You must have the legal capacity to enter into this agreement under the law that applies to you. If you do not, you may use Nativa only with the permission and supervision of a parent or legal guardian who accepts these Terms on your behalf.
4. Accounts and sign-in
Some features require an account. Sign-in may rely on your email address and a session on your device. You are responsible for maintaining control of your email account, sign-in links, sessions and devices, and for activity that occurs through them. Tell us promptly if you believe your account has been used without your authorisation.
5. Your content
You keep all rights you have in the content you submit. You grant Becoming Labs Limited a limited, non-exclusive licence to host, transmit and process that content only as necessary to deliver the features you request and to operate, secure and support the service. You must have the right to submit any third-party content you ask Nativa to process.
6. AI outputs
AI-generated translations, drafts and explanations may be inaccurate, incomplete or contextually wrong. You are responsible for reviewing any output before relying on it, sending it, or acting on it. Nativa does not provide legal, medical, financial or other professional advice.
7. Third-party platforms and services
Nativa works alongside independent messaging, social and web platforms and relies on third-party service providers such as cloud, authentication and AI providers. We are not affiliated with, endorsed by or sponsored by those platforms unless we state so explicitly. Their terms and policies continue to apply to your use of them, and their availability and behaviour are outside our control.
8. Acceptable use
- no unlawful activity, harassment, abuse, spam or fraud;
- no interference with the security or integrity of Nativa or any connected service;
- no automated or bulk use that harms the service or other users;
- no infringement of intellectual property, privacy or other rights;
- no attempt to circumvent usage limits, access controls or membership entitlements.
9. Usage limits and membership
Some features may be subject to quotas, membership tiers or other limits, and these may change as the product develops. Nativa offers Free, Plus and Pro membership, which may have different limits and features as shown on our pricing page and on current product surfaces.
Plus and Pro are recurring monthly subscriptions charged in USD at the price shown to you before purchase, processed through Stripe Checkout. Subscriptions renew monthly until cancelled.
You can open the Stripe-hosted Billing Portal from /billing/manage to manage your plan, payment method, billing history and cancellation, subject to the options enabled in that portal. Under the current configuration, a cancellation made through the Billing Portal is scheduled to take effect at the end of the billing period you have already paid for, and a Plus/Pro plan change uses Stripe's displayed billing treatment: upgrades are charged with proration as shown, and downgrades are scheduled for the next billing period. The amount and billing treatment are shown by Stripe before you confirm.
If a subscription is in a failed or otherwise non-entitling status, paid access may be affected according to the membership state recorded for your account. Nothing in these terms limits mandatory consumer or refund rights you may have under applicable law.
10. Data and privacy
Our Privacy Policy explains how we handle personal information. Communication Learning and the higher-risk Data Use Permissions are optional and OFF by default, and you can withdraw them independently.
11. Data-use statement
Nativa does not sell personal information, and does not use Chrome extension user data — including derived, aggregated, anonymized or de-identified data — for advertising, data brokerage, unrelated commercial datasets, or generalized model-development training.
Where you explicitly authorise Aggregate improvement, the privacy-safe structured signals covered by it are used only to improve and evaluate Nativa's disclosed communication-assistance product purpose.
12. Intellectual property
The Nativa software, interfaces, documentation and branding are owned by Becoming Labs Limited or its licensors. These Terms do not transfer any of those rights to you. Your content remains yours or the relevant rights holder's.
13. Availability, changes and termination
We may update, change or discontinue features, and we may suspend or terminate access where it is reasonably necessary — for example for a material breach of these Terms, a legal requirement, a security risk, or discontinuation of the service. Where reasonably practicable we will give notice. You may stop using Nativa and remove the extension at any time.
14. Disclaimers
We provide Nativa with reasonable care and skill, but we cannot guarantee that the service will be uninterrupted, error-free, or that outputs will be accurate or fit for a particular purpose. Nothing in these Terms limits any guarantee or right that cannot lawfully be excluded, including under the New Zealand Consumer Guarantees Act 1993 or equivalent consumer law that applies to you.
15. Liability
To the extent permitted by law, Becoming Labs Limited is not liable for indirect or consequential loss, or for loss of profits, data or opportunity arising from your use of Nativa. Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited, including under applicable consumer and privacy law.
16. Governing law
These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction. This does not remove mandatory consumer or privacy protections that may apply to you in the country where you live.
17. Changes and contact
We may update these Terms as Nativa changes. Updated Terms are published here with a new effective date and version identifier. For material changes, we will provide notice where reasonably practicable or where required by law. Where applicable law requires renewed acceptance or consent, we will request it. Otherwise, continued use of Nativa after the effective date constitutes acceptance of the updated Terms.
